These Terms and Conditions (“Terms”) govern all transactions made on madisonandbrooks.com (the “Site”) or at any Madison & Brooks showroom or authorized location. By accessing the Site or placing an order, you agree to be bound by these Terms. Please review them carefully and retain a copy for your records.

We also encourage you to read our Privacy Policy to understand how we protect and use your personal information.

1. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your login. If you are under 18 years of age, you may use this Site only with the involvement of a parent or guardian. Madison & Brooks reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our discretion.

2. Shipping & Delivery

All delivery timelines are provided as good faith estimates. While we strive for prompt delivery, Madison & Brooks is not responsible for delays caused by external factors such as logistics partners, weather, or supply chain disruptions. We do not ship to P.O. boxes.

3. Product Availability & Terms of Sale

Product availability is based on inventory levels at the time of ordering and is not guaranteed. Orders cannot be canceled or refunded due to delays in availability. Customers are solely responsible for confirming furniture dimensions, functionality, and suitability for intended use and space.

Madison & Brooks is not liable for any incidental or consequential damages, whether arising from product use, delay, or performance. Our maximum liability shall not exceed the purchase amount paid.

4. Custom & Special Orders

Custom and made-to-order items (including specific fabric, finish, sizing, or configuration requests) are final sale and non-refundable. Changes or cancellations must be made within 24 hours of order placement.

We recommend reviewing your selections carefully before confirming. Customization may not always incur an additional fee—please contact us to discuss your request.

5. Pricing

Prices listed on the Site reflect the current selling price. Any “market value” reference is a subjective estimation for reference only and should not be considered an official market benchmark.

6. Cancellations & Restocking Fees

All cancellations are subject to approval. Orders canceled after 72 hours may incur a 35% restocking fee, along with any applicable shipping costs. Layaway, special, and custom orders are not eligible for cancellation or refund.

Any order modifications must be requested within 3 calendar days of purchase and prior to scheduling delivery.

7. Receiving Damaged Items

Every shipment is insured. Upon delivery, we ask that you inspect all items immediately. If any product is visibly damaged, please write “Damaged Upon Arrival” on the delivery form and refuse the item. Once verified, we will issue a replacement or initiate a claim as appropriate.

For damages noticed after delivery, please email photos and a description to our customer support team within 5 days of receipt. Madison & Brooks is not responsible for damage caused by third-party carriers once delivery has been accepted.

Curbside delivery requires the customer to unpackage and move items inside. In the event of damage, please contact us immediately.

8. Returns & Exchanges

Returns are accepted only for non-customized items and require pre-authorization.

  • Request must be made within 7 days of delivery
  • Items must be in original condition and packaging
  • A 35% restocking fee applies
  • Return shipping is the customer’s responsibility

Custom, special order, and layaway items are non-refundable. Approved returns are eligible for store credit only. Store credit is valid for one year and may not be reissued or extended.

9. Sales Tax

Sales tax is applied based on delivery address.

10. Payment Methods

We accept all major credit cards, including Visa, MasterCard, American Express, and Discover. Full payment is required at checkout. Orders are processed once payment is confirmed.

11. Order Status

You may check the status of your order by logging into your account on our Site. For assistance, contact our customer service team at concierge@madisonandbrooks.com.

12. Product Availability

All products are subject to availability. In the rare event that a product becomes unavailable after purchase, we will issue a full refund for the affected item. We are not liable for any other resulting costs or damages.

13. Typographical Errors

We strive for accuracy but reserve the right to cancel orders in the event of pricing, description, or inventory errors. If your card was charged for an item in error, we will issue a full refund promptly.

14. Disclaimer of Warranties

This Site and all products and services are provided “as is” and “as available.” Madison & Brooks disclaims all warranties, express or implied, to the fullest extent permitted by law.

15. Indemnification

You agree to indemnify and hold harmless Madison & Brooks and its affiliates, employees, and agents from any claims or damages arising from your use of the Site or our products.

16. Termination

We reserve the right to suspend or terminate your account if we believe there has been a violation of these Terms.

17. Legal & Governing Law

These Terms are governed by the laws of the State of Florida and the United States of America. All transactions are deemed to have occurred in Florida.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining terms will remain in full effect.

19. Changes to These Terms

Madison & Brooks reserves the right to update these Terms at any time. Continued use of the Site following any changes indicates your acceptance of the revised Terms.
